Disclaimer: These terms were drafted by the product team and should be reviewed by qualified legal counsel before official publication.

This document is available in both Chinese and English. The Chinese version is the primary version. The English version is a Reference Translation. In case of legal disputes, the Chinese version shall prevail.

1. Acceptance of Terms

Welcome to Nourai. Please read these Terms of Service ("Terms") carefully before accessing or using the app. By using Nourai, you agree to be bound by these Terms. If you do not agree to any part of these Terms, please stop using the app immediately.

You must be at least 13 years old to use this service. If you are under 18, you represent that you have obtained permission from your parent or legal guardian.

2. Service Description

Nourai is an AI-powered food and nutrition tracking application developed by the Paradox team. The service is provided through the iOS App, Android App, and nourai.app website.

Core features include:

  • AI Food Photo Recognition: Uses AI vision models to automatically identify food types and estimate weight
  • Nutrition Tracking: Records daily dietary intake and automatically calculates energy and macronutrients (carbs, protein, fat)
  • Nour AI Assistant: An AI-powered nutrition coach providing personalized dietary advice and trend analysis
  • Voice Entry: Describe your meals by voice and AI automatically creates the entry
  • Barcode Scanning: Scan packaged food barcodes to automatically retrieve nutrition information
  • Nutrition Label OCR: Photograph nutrition labels to automatically extract nutritional data
  • Weekly Insights: AI-generated weekly dietary analysis reports

Nutrition data is sourced from two authoritative databases: USDA FoodData Central (U.S. Department of Agriculture, public domain) and Open Food Facts (open database, ODbL v1.0 license).

3. User Accounts

An account is required to access the full features of Nourai. When registering:

  • You must provide a real and accurate email address
  • We support Apple Sign In, Google Sign In, and email/password registration
  • You are responsible for safeguarding your account credentials (password or third-party login tokens) and for all activities that occur under your account
  • Each person may register only one account. Accounts may not be transferred, sold, or shared with others
  • If we discover a security risk or a violation of these Terms associated with your account, we reserve the right to suspend or terminate your account

If you become aware of any unauthorized use of your account, please contact privacy@nourai.app immediately.

4. Acceptable Use

When using Nourai, you agree not to:

  • Use the service for any illegal purpose
  • Upload photos or text containing violent, pornographic, hateful, or otherwise unlawful content
  • Attempt to reverse-engineer, decompile, disassemble, or otherwise crack the application
  • Abuse AI features, including but not limited to using the Nour AI assistant to obtain medical diagnoses or prescription advice
  • Access the service API using automated tools, scrapers, or bots
  • Interfere with, damage, or attempt to disrupt the normal operation of the service, including servers, networks, or security infrastructure
  • Impersonate any person or misrepresent your affiliation with any person or entity
  • Collect, store, or process personal data of other users

Violation of the above provisions may result in immediate suspension or permanent termination of your account without prior notice.

5. Intellectual Property

5.1 Paradox's Intellectual Property

The Nourai App, brand name, logos, user interface designs, software code, and AI model integration methods are the intellectual property of the Paradox team, protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of the service without our prior written consent.

5.2 User Content

You retain copyright ownership of content you upload (food photos, text records, voice input). By using the service, you grant Paradox a limited, non-exclusive, revocable license solely to:

  • Provide service functionality (such as AI food recognition, nutrition label OCR)
  • Store and display your diet entries within the scope of your account

Our commitment: Your uploaded photos and data will not be used to train AI models, will not be shared between users, and will not be used for any marketing purposes.

5.3 Third-Party Data Licenses

  • USDA FoodData Central: Public domain data with no copyright restrictions
  • Open Food Facts: Licensed under the Open Database License (ODbL) v1.0. Per ODbL terms, any database derived from this app remains ODbL-licensed

6. AI Features Disclaimer

Nourai uses artificial intelligence technology to provide food recognition and nutrition advisory services. Please note the following important disclaimers:

  • AI food recognition results (food type, weight estimation) are provided as assistive references and may contain errors. You should review recognition results and make corrections as needed before confirming
  • Nutrition data comes from the USDA and Open Food Facts authoritative databases, but due to natural variations in food (origin, cooking method, variety differences), exact correspondence with actual intake is not guaranteed
  • Dietary advice and nutritional analysis provided by the Nour AI assistant do not constitute medical advice, nutritional prescriptions, or health diagnoses
  • If you have any health conditions, dietary restrictions, or special nutritional needs, please consult a qualified physician or registered dietitian
  • Users should exercise their own judgment regarding the reasonableness of AI outputs and bear ultimate responsibility for decisions made based on AI recommendations

Zero-LLM-fabrication nutrition commitment: Our AI only identifies food types and estimates weights. All nutrition values come from authoritative databases (USDA, Open Food Facts) and are never generated or fabricated by LLMs.

7. Subscriptions & Payments

Current version: Nourai is currently completely free, with all features available to all users.

Future plans: We may introduce Nourai Plus, a premium subscription service, in the future offering advanced insights, unlimited AI conversations, and personalized meal recommendations. In that case:

  • Subscriptions will be managed through Apple App Store or Google Play Store in-app purchases
  • Refund policies will follow the respective app store regulations
  • Users will be notified in advance of any price changes
  • Existing users will retain free access to core features

8. Privacy

How we collect, use, and protect your personal data is detailed in the Nourai Privacy Policy. The Privacy Policy is an integral part of these Terms of Service.

By using the service, you consent to the processing of your personal data as described in the Privacy Policy. We are committed to providing services based on the principle of data minimization and to complying with applicable data protection laws (including GDPR).

9. Service Changes & Interruptions

Paradox reserves the right to modify, suspend, or terminate the service (in whole or in part) at any time, including:

  • Feature updates: Adding, modifying, or removing specific features
  • Scheduled maintenance: We will make reasonable efforts to notify you in advance of planned maintenance windows
  • Emergency maintenance: Unforeseen maintenance due to security threats or critical failures

Paradox shall not be liable for service interruptions caused by force majeure events (including but not limited to: natural disasters, server failures, third-party API outages, network provider failures).

Service interruptions do not affect your data rights. Even during service suspension or termination, you can still request data export or account deletion via privacy@nourai.app.

10. Disclaimer of Warranties

The service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, Paradox expressly disclaims the following warranties (whether express or implied):

  • Warranty of merchantability
  • Warranty of fitness for a particular purpose
  • Warranty of non-infringement
  • Warranty that the service will be uninterrupted or error-free
  • Warranty of the accuracy of AI recognition results
  • Warranty that nutrition data will exactly match actual food

You understand and agree that your use of the service is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Paradox and its directors, employees, partners, and agents shall not be liable for:

  • Any indirect, incidental, special, punitive, or consequential damages
  • Loss of profits, loss of goodwill, loss of data, or other intangible losses
  • Losses arising from the use of or inability to use the service
  • Losses arising from decisions made based on AI recognition results or Nour AI recommendations

Liability cap: In no event shall Paradox's total liability to you exceed the total amount you have actually paid to Paradox in the preceding 12 months (currently $0).

Some jurisdictions do not allow the exclusion or limitation of certain types of damages. If these laws apply to you, some or all of the above exclusions or limitations may not apply. In that case, applicable local law shall prevail.

12. Indemnification

You agree to indemnify, defend, and hold harmless Paradox and its directors, employees, and agents from any third-party claims, actions, losses, liabilities, damages, costs, and expenses (including reasonable attorney fees) arising from:

  • Your violation of any provision of these Terms
  • Your uploaded content infringing third-party rights
  • Your misuse of the service or AI features
  • Your violation of applicable laws or regulations

13. Dispute Resolution

Governing law: These Terms shall be governed by the laws of the People's Republic of China (excluding conflict-of-law rules), or by the mandatory provisions of local law in your jurisdiction of residence.

Amicable negotiation: Any dispute arising from or relating to these Terms shall first be attempted to be resolved through amicable negotiation. You may initiate negotiations by contacting legal@nourai.app.

Formal dispute resolution: If negotiation fails to resolve the dispute within 30 days, either party may submit the dispute to a court or arbitration body with competent jurisdiction.

Class action waiver: To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class action or representative action.

14. Modifications to Terms

Paradox reserves the right to modify these Terms at any time. Material changes to these Terms will be communicated via:

  • In-app notifications
  • Email notification to your registered email address
  • Updating the "Last Updated" date at the top of this page

Continued use of Nourai after receiving notice of changes constitutes acceptance of the modified Terms. If you do not agree with the modified Terms, please stop using the service and delete your account.

15. Miscellaneous

  • Entire agreement: These Terms (together with the Privacy Policy) constitute the entire agreement between you and Paradox regarding the use of the service, superseding any prior oral or written agreements
  • Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall remain in full force and effect
  • No waiver: Paradox's failure to exercise or delay in exercising any right under these Terms shall not constitute a waiver of that right
  • Headings: Section headings in these Terms are for convenience of reading only and do not affect the interpretation of the Terms
  • Assignment: You may not assign any rights or obligations under these Terms without Paradox's prior written consent. Paradox may assign these Terms to a successor entity upon reasonable notice
